By choosing hugster.love for individual and personal textile dye sublimation printing, the customer agrees to our terms and conditions as follows:

Copyrights

The customer warrants that the photographic material and/or all material to be printed is not copyrighted by a third party. The customer also recognizes that because supplied photographic material and/or all material does not have to bear a copyright notice in order to be protected by copyright law. The absence of such notice does not necessarily assure a right for reproduction.

hugster.love denies all further sublimation printing and processing for TM registered material, cartoon material, corporate logos, any form of infringing photographic content. All customers must ensure that they fully own all copyrights to their photographic and/or all material submitted with hugster.love.

The customer further warrants that no copyright notice has been removed from any material used in preparing the photographic material for reproduction. To support these warranties, the customer and all other parties agree to indemnify and hold hugster.love harmless for all liability, damages, and attorney fees that may be incurred in any legal action in connection with copyright infringement involving the photographic material and/or all material produced or provided by the customer and/or other parties involved.

Presenting photographic material and/or all material for printing represents that the customer is the sole author of the Work and is the owner of the copyright and/or to all of its contents. The customer has not engaged in plagiarism and that the photographic material and/or all material, if fiction, represents no real event or person(s) that could in any way be deemed libellous and that, if nonfiction, does not misstate or omit any fact which would libel any person(s) or result in a person(s) being placed in a false or damaging light.

The customer agrees that the photographic material and/or all material does not infringe the copyright, trademark or privacy of any third party. The customer is the rightful owner of any trademarks and/or trade names associated with the photographic material and/or all material and that the photographic material and/or all material does not constitute obscenity and/or hate and/or racist literature or photographic material and that the author has the right to enter into this agreement.

Customers who’s photographic material and/or all material was deemed unfit by hugster.love and its associates for printing and/or further processing will be reimbursed.

Jobs cancelled by hugster.love require compensation for incurred costs and related obligations. A $40 administrative fee will be withheld. The remaining amount after the deduction of the administrative fee, if any, will be reimbursed to the customer.

Photographic material

All digitally submitted photographic material is the clients property. hugster.love reserves the right to make use of all photographic material submitted by customers for schooling and demonstration purposes.

Electronically submitted photographic material

It is the customer’s responsibility to maintain a copy of the original file. hugster.love is not responsible for accidental damage or loss of photographic material and/or all material supplied by the customer.

No liability is assumed for problems of any kind that may arise. No additional editing, nor programming will be conducted at any time in order to utilize customer-supplied photographic material. All submitted photographic material by customer is final and will be used, if deemed appropriate, for further processing and dye sublimation printing.

Colour consistency

Because of differences in equipment, dye sublimation printing paper, inks, and/or other conditions affecting the colour consistency between the digital photograph and production pressroom operations, a reasonable variation in colour between the digital photograph and the completed job is to be expected. When a variation of this kind occurs, it will be considered acceptable performance. hugster.love will always do its best to reasonably colour match the final dye sublimation print and the digital photograph supplied by the customer.

Inappropriate photographic material protection

hugster.love prints and ships digitally submitted photographic material by dye sublimation printing method on a one or double sided double plush body pillow cover.

In order to protect our associates in all departments such as digital photography processing, digital printing processing, hot press room processing and/or shipping and handling processing, hugster.love reserves the right to determine unsuitable photographic material and/or all material at its own decision.

Unsuitable photographic material such as sexual material, pornographic material, nudity or any form of nude or inappropriate exposure material and/or indecent material will not be dye sublimation printed by hugster.love.

hugster.love reserves the right to use our sole discretion in refusing to print anything hugster.love deems illegal, libelous, scandalous, improper, or infringing upon copyright law.

Customers who’s photographic material was deemed unfit for sublimation printing and further processing will be reimbursed. Orders Acceptance

Acceptance of orders is subjected to circumstances such as fire, water, strikes, theft, vandalism, acts of God, and other causes beyond hugster.love’s control.

Acceptance of orders is also subjected to full online payment for all online orders by all customers. All order details such as shipping address, billing address and/or all other order details must be indicated in full.

Acceptance of order is also subjected to fulfilment of all copyright, no infringements to copyrights and appropriateness of photographic material submitted online with hugster.love by all customers.

Returns & Refunds & Reprint Policy

All textile dye sublimation printing executed by hugster.love are individually personalized printing products that cannot be returned once they have been received by the customer. All sales are final. Defective material can be returned and will be inspected. If inspections find that the material used was in fact defective, a replacement pillow cover can be printed.

By accepting the individually dye sublimation printed order, the customer acknowledges that hugster.love’s performance has fully satisfied all terms, conditions, and specifications. hugster.love’s liability will be limited to the defective goods, without additional liability for special or consequential damages.

In the unlikely case that a customer contacted us, we will require five (5) business days to determine if a reprint is appropriate, or advise you, if more information is needed to process your inquiry. If we request additional information to verify an inquiry and the additional information is not provided within a reasonable timeframe, we will no longer be under any obligation to provide a reprint.

Personal injury indemnification

The customer agrees to protect hugster.love from economic loss and/or any other harmful consequences that could arise in connection with the printed products.

This means that the customer will hold hugster.love harmless and save, indemnify, and otherwise defend hugster.love against claims, demands, actions, and proceedings on any and all grounds. This indemnification will apply regardless of responsibility for negligence.

All customers and/or other parties using hugster.love printed products and/or other products such as pillow inners or parts thereof shall be liable for any physical damage, allergies, destruction, injury and/or death that might arise from using hugster.love printed products and/or pillow inners and/or parts thereof inclusive of all wrapping and shipping material used by hugster.love. This indemnification is also applicable if customers and/or other parties act with negligence or wilful or wanton acts or omissions.

Jurisdiction

The parties agree that all disputes arising under this agreement shall be governed by Florida law, Lee County, Fort Myers. The parties further agree that the Courts of the State of Florida shall be the sole and exclusive jurisdiction and venue in which any dispute arising under this agreement shall be determined.
